Sparks Woman Has An Unusual Case
Asks Divorce On Peculiar Grounds
Court Holds Not A Proper Proceeding

"Mrs. Elsie K. Daniels, who has resided in Sparks for several years today appeared in the district court and asked for a decree of divorce from Emmer Daniels, said to be a brakeman on the limited running Overland Limited out of Sparks. She asked for a decree on the ground her husband had a wife living at the time he married her and that wife is still living.

After hearing the testimony Judge Pike stated that in his opinion there was no preceding for divorce as no legal marriage had been performed. The matter is held open though at this time the plaintiff may institute a suit for the annulment of the marriage. Whether or not any action will be taken against Daniels on a charge of bigamy has not been determined.

The second wife has a pretty little boy and if a suit of the annulment of the marriage is brought it is possible that a suit will also be brought to make the father provide for this child during its infancy."

In 1920 Emmer and Theodore are enumerated in Sparks, no other information but their names are given as it states, they aren't home. It does state however that Emmer is a widow and Theodore is his son.
