About 1799 he married Ann COX and they lived on land called "Three Forks", which was inherited from Ann's father, Capt. John COX who was an American Revolutionary War veteran. Their children are established by the Bible record of their oldest son Zachariah.

1840/11/24 Deed Book M p283, State of North Carolina, James BAKER to Nancy BAKER: "Know ye that I, James BAKER, of Ashe and State of North Carolina being moved by the good and parentel feeling toward my daughter Nancy RAY and her children, do hereby give and bequeath to the said Nancy RAY, one negro girl by the name of Violet, age about 14 years, to labor for her and her children during the life time of my said daughter, Nancy RAY, and after her death the said negro girl, Violet, I give with all her increase if any to the said children of the said Nancy RAY. In testimony whereof I have hereunto set my hand and seal this 24th day of November 1840". (signatures) James BAKER, James M.
