A FATHER'S COMPLAINT AT INQUEST - Coventry Evening Telegraph - 10th August 1951

Assurances that his complaint about safety precautions on a building site would be fully considered were given to a Coventry father at an inquest yesterday.

He was Herbert Jinks of 19 Edyth Rd, Wyken, Coventry and the inquest was on his six year old son, Malcolm Barry Jinks, who was drowned in a ducthole on the building site in Axeholme Rd, on Tuesday morning. The hole was 6ft. by 4ft. and 5 and a half feet deep. As a result of Monday's heavy rain there was 5ft. of water in it.

A friend whom Malcolm had been playing with at the time of the accident, told the coroner that they had been jumping in and out of puddles. He did not know that Malcolm had fallen into the hole until he heard him shouting. Then he and another boy tried to get him out with a stick.

A chargehand for Messers. Wimpey at the site, said that he was told by children that a boy had been drowned. He tried artificial respiration after getting the boy out of the hole. Police evidence stated that Coventry ambulance men used "Novox" appliances.

Dr. A. S. Gould, Casualty Officer at Coventry And Warwickshire Hospital, said that there were no external marks on the boy and that death was due to drowning.

Agreeing that the rain had filled the hole and created a danger that had not previously been there, the boy's father said "The site had been used for years before building started, as a playground for all the children in the neighbourhood. The danger should have been seen by those responsible. The entrance to the site from the road is only about 75 yards wide. Surely it could have been fenced off?"

In answer to questions, Mr. Moran said that the evcavations were 250 yards from the highway. It would be a huge job to fence the area and it was impossible to fence ductholes.

REcording a verdict of "Accidental death," the Coroner, Mr. C. W. Lliffe, said, "I feel every word that Mr. Jinks has aid about this matter. But we have to look at these things from a practical point of view. I am sure that his Majesty's Inspector of Factories and Messers. Wimpey will take all he has said in to consideration."

Malcolm died aged 6 years.
